“It’s not a controlled drug. It’s a legend drug — so it’s still a controlled drug to a certain extent.” Even after the arrest they’re still not sure what was in the vials. And, they do not know what the legal status of what was in the vials except that even if it was a GLP1, they don’t know what that means — yet they charged her with an additional charge of reckless endangerment with a deadly weapon. Un-fucking-de-blievable. Dude. I don’t care how good her defense counsel may be — she is going to sit for some time! And all because the people she was selling to felt it was dicey to pick it up from her house, so they called the police. You just gotta laugh; poor idiot.

I cannot imagine a criminal law practice in western Tennessee. But I can tell you that looks like a serious ass felony. How many people are waving guns around right now and driving drunk throughout the state and will never even come close to such a charge.
 
I think this is a case of someone doing wrong but the authorities not really know which charges to file. In this case, throw everything at her and see what sticks. When all is said and done she may not do the "time", but is definitely doing the "ride". I think I read in another article that her bail was set at $100k so if she can't come up with it, or the bond, she will probably sit in jail for a year until it goes to trial.

These appear to be state charges. I don't know about Tennessee.

For those interested in federal law on the topic, see FDA, Warning Letter No. 668918, to Synthetix Inc. DBA Helix Chemical, No. Supply (Feb. 7, 2024).

Violation of the federal laws on the subject is punishable criminally. 18 U.S.C. § 333.

The federal government appears largely apathetic about these cases because it has issued warning letters in cases where it could have pursued criminal prosecution.

Still if you're selling peptides, be careful. Speak to an attorney familiar with the sale of GLP-1 drugs supposedly for research purposes.

Selling these to a Med Spa was probably the kicker. It's one thing to be selling "research chemicals" directly to buyers. It's a whole other ballgame laundering research chemicals into legit pharmaceuticals that people trust are FDA approved and administered under medical supervision

They are just stacking charges. I think this is a backwoods police department that is in over their head.

Those spas should be held accountable as well. What kind of idiot would believe unconstituted peptides were legit? Even a lowly nurse should be able to call that out and I believe those places have PAs and NPs seeing over them.

You're correct. However, I'm even more angry at these med spas that were selling the stuff. They ought to buy compounded tirzepatide and openly state they're doing so.

Super shady. I'm sure they knew what they were selling to people wasn't "legit". They should be the ones in jail right now, and not the person smuggling research chems into the country.
 
We consider this a violent crime…..omg…..she also shipped them out of Tennessee which would make it a federal crime if the Feds want to get involved ….. not smart. Did the Medspa’s get an extra special COA? Lol

She doesn’t have to ship them out of Tennessee for it to be a federal crime. Her activity just has to affect interstate commerce. Since she’s buying them from out of state, directly or indirectly, that affects interstate commerce. As a lawyer, I know almost everything is found to affect interstate commerce.

I think this is reasonable. This place, Peppys, etc., try to make it very clear to people what the risks are around buying "research chemicals." We know that there are potential contamination issues in the base product, that reconstitution is another vector for contamination. We know that without testing we might not even know what we're getting. We know that some of these labs have ties to other labs that produce opioids.

These people thought they were getting legitimate versions of the drugs and were confused when they had to show up at someone's house. It's obvious she wasn't informing them of the risks. And there really are risks, potentially even life threatening ones.
