You should be able to file a missing mail claim with USPS. I have had to file those a couple of times. 1 x was unsuccessful like I mentioned in this thread and a prior time I did it my local office did find the package.
I would not expect a Chinese middle man sales agent to go on to USPS and file some sort of claim on your behalf. Doing something like that could probably put them at risk somehow.
